1. Introduction

BuildFund is a digital construction and building-material platform operated by BuildTech Technologies Pvt Ltd ("BuildFund", "we", "us", or "our").

We respect your right to control your personal data. This Data Deletion Policy explains how BuildFund users can request deletion of their account and eligible personal data collected through the BuildFund website and mobile application.

This policy should be read together with our Privacy Policy, which explains in greater detail how BuildFund collects, uses, processes, stores, and protects personal data.

2. What You Can Request to Delete

Depending on your account type and the information associated with your account, you may request deletion of eligible personal data, including:

• Account and profile information associated with your BuildFund account.
• Personal contact information associated with your account, subject to applicable retention requirements.
• Construction-site information that is eligible for deletion.
• Uploaded documents and images, where their deletion is legally permissible.
• Product or business information associated with a Trader account, where applicable.
• Other eligible personal data associated with your account.

3. How to Delete Your BuildFund Account

If the account deletion option is available in the BuildFund application, you may initiate deletion directly from your account.

Delete from the BuildFund Application

1. Open the BuildFund application.
2. Go to your Profile or Account section.
3. Open the account settings.
4. Select the available Delete Account option.
5. Review the deletion information displayed by the application.
6. Confirm your account deletion request.

If the in-app deletion option is not available to you, you can submit a deletion request by email as described below.

4. Request Data Deletion by Email

You can request account and eligible data deletion by sending an email to:

• Your full name;
• Your registered mobile number;
• Your registered email address, if applicable;
• Your BuildFund user type, such as Home Owner, Contractor, or Trader; and
• A clear statement requesting deletion of your account and eligible personal data.

You should send the request from your registered email address, where applicable.

5. Identity and Account Verification

To protect your account and prevent unauthorised deletion, BuildFund may need to verify that the deletion request was made by the account owner or an authorised person.

Depending on the circumstances, we may request additional information reasonably necessary to verify account ownership.

We will not request unnecessary personal information merely to process a deletion request.

6. What Happens After You Request Deletion

After receiving a deletion request, BuildFund may take the following steps:

1. Receive and acknowledge the request.
2. Verify the identity or account ownership of the person submitting the request, where necessary.
3. Review the information associated with the account.
4. Identify personal data that can legally and technically be deleted.
5. Delete, anonymise, or otherwise remove eligible information from active systems.
6. Retain information that is required or permitted to be retained under applicable law.
7. Provide confirmation when the deletion request has been completed, where appropriate.

7. Processing Time

BuildFund aims to process verified deletion requests within a reasonable period and in accordance with the timelines prescribed under applicable law.

Where additional verification, technical processing, legal review, or other circumstances require additional time, we may communicate the applicable status or expected timeframe to you.

Where the law prescribes a specific timeline for responding to a deletion request, BuildFund will follow that applicable timeline.

8. Information That May Be Retained

Certain information may not be immediately deleted where BuildFund is required or permitted to retain it under applicable law or where retention is reasonably necessary for legitimate purposes.

Depending on the circumstances, this may include:

• KYC and identity-verification records where retention is required by law or regulatory requirements.
• Orders and transaction records necessary for legal, accounting, commercial, or dispute-resolution purposes.
• Invoices and business records required for tax, accounting, or legal purposes.
• GST or other statutory records where applicable retention requirements apply.
• Security and audit logs required for security, fraud prevention, investigations, or legal compliance.
• Records relating to disputes or legal proceedings where retention is necessary to establish, exercise, or defend legal claims.

9. Deletion of KYC Documents

If you have submitted KYC or identity documents to BuildFund, those documents may contain sensitive personal information.

Where legally and operationally permissible, eligible KYC documents and associated personal data will be deleted or securely disposed of following a valid deletion request.

However, if applicable law requires BuildFund to retain a KYC record for a specified period, the relevant information may be retained until that retention period expires.

10. Orders, Invoices and Business Records

Deleting your BuildFund account may not result in immediate deletion of every order, invoice, business, or commercial record associated with your account.

Such information may need to be retained where reasonably necessary for:

• Tax and accounting requirements;
• Legal obligations;
• Regulatory requirements;
• Dispute resolution;
• Fraud prevention;
• Security and audit purposes; or
• Establishing, exercising, or defending legal claims.

11. Information Shared With Other Users

BuildFund is a marketplace connecting Home Owners, Contractors, and Traders.

Certain information may have been shared with another BuildFund user as part of an order, delivery, business interaction, or construction-related activity.

Deleting your BuildFund account does not necessarily mean that copies of information already received by another user can be remotely deleted from that user's independent records.

BuildFund will, however, delete eligible information from its own systems in accordance with this policy and applicable law.

12. Information That Cannot Be Deleted Immediately

A deletion request may not result in immediate deletion where:

• Retention is required by applicable law;
• The information is required for tax or accounting purposes;
• The information is required for KYC or regulatory compliance;
• The information is required to investigate fraud or security incidents;
• The information is required to establish, exercise, or defend legal claims;
• The information forms part of a legal or regulatory record;
• Deletion would adversely affect the rights of another person; or
• Retention is otherwise permitted under applicable law.

Where retention is necessary, BuildFund will retain the relevant information only for the period reasonably required for the applicable purpose.

13. Data Deletion and the DPDP Act, 2023

BuildFund recognises the rights available to Data Principals under the Digital Personal Data Protection Act, 2023, and applicable rules and regulations.

Where applicable, users may exercise their rights relating to personal data, including rights concerning access, correction, erasure, consent withdrawal, and grievance redressal.

The exercise of these rights remains subject to applicable legal requirements, including circumstances where BuildFund is required or permitted to retain information.

14. Fraud and Security Records

BuildFund may retain certain security, audit, and fraud-prevention records even after account deletion where such retention is reasonably necessary to:

• Protect BuildFund and its users;
• Investigate security incidents;
• Prevent repeated abuse;
• Detect fraudulent activity;
• Comply with legal obligations; or
• Support legal proceedings.

15. Withdrawal of Consent

Where personal data is processed on the basis of consent and applicable law permits withdrawal, you may withdraw your consent through the mechanism provided by BuildFund or by contacting us.

Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

Withdrawal may also affect our ability to provide certain services where the relevant personal data is necessary to provide those services.

16. Deletion Request for a Deceased User

Where applicable under the DPDP Act and relevant rules, an authorised person or nominee may exercise rights relating to a deceased user's personal data in accordance with applicable law.

BuildFund may require appropriate documentation or verification before processing such a request.

17. Re-Registration After Account Deletion

After your BuildFund account has been deleted, you may be required to create a new account if you wish to use BuildFund again.

Previous account information may not be restored after deletion, except for information that BuildFund is legally required or permitted to retain.

By using BuildFund, you acknowledge that you have read and understood this Data Deletion Policy and the procedures available for requesting deletion of your account and eligible personal data.
