These Terms & Conditions ("Terms", "Terms & Conditions") govern your access to and use of the BuildFund website, mobile application, platform, products, features and related services (collectively, the "Platform") operated by BuildTech Technologies Pvt Ltd ("BuildFund", "we", "us", or "our").

By accessing, registering on, or using BuildFund, you acknowledge that you have read, understood and agreed to be bound by these Terms, our Privacy Policy and our Data Deletion Policy.

1. About BuildFund

BuildFund is a digital platform intended to facilitate interactions and information exchange among participants in the construction and building materials ecosystem, including homeowners, contractors, traders and other users.

Depending on the features available to you, BuildFund may allow users to create profiles, provide project or construction information, discover products or services, communicate with other users, submit enquiries, manage project-related information and use other features made available from time to time.

BuildFund may modify, add, suspend or discontinue any feature or service at any time, subject to applicable law.

2. Eligibility

By using BuildFund, you represent that the information provided by you is accurate and that you are legally capable of entering into these Terms.

If you are using BuildFund on behalf of a company, firm, business or other organisation, you represent that you have the authority to bind that organisation to these Terms.

BuildFund is not intended to be used by children in violation of applicable law. If you are a minor, you should use the Platform only with the involvement and consent of your parent or lawful guardian where required.

3. Account Registration

Certain BuildFund features may require you to create an account or provide registration information.

You agree to:

  • provide accurate, current and complete information;
  • keep your account information updated;
  • maintain the confidentiality of your login credentials;
  • not share your account with unauthorised persons;
  • notify BuildFund if you suspect unauthorised access to your account; and
  • accept responsibility for activity carried out through your account, subject to applicable law.

BuildFund may require additional information or verification where reasonably necessary for security, KYC, fraud prevention, regulatory or operational purposes.

4. User Types

BuildFund may support different categories of users, including:

  • Home Owners
  • Contractors
  • Traders
  • Other construction-industry participants

Certain features may differ depending on your user category, location, verification status or other applicable criteria.

5. User-Provided Information

You may provide information relating to yourself, your business, construction projects, sites, requirements, products, documents, communications and other activities on the Platform.

You are responsible for ensuring that information you submit is accurate, lawful and does not knowingly infringe the rights of another person.

You must not upload or submit information that you do not have the right to provide to BuildFund or disclose through the Platform.

6. KYC and Verification

BuildFund may request identity, business or other verification information where required for Platform functionality, trust and safety, fraud prevention or applicable legal requirements.

Submission of KYC information does not guarantee approval, verification, access to any particular feature or acceptance of any transaction or relationship.

BuildFund may suspend or restrict accounts where information is incomplete, inaccurate, misleading or cannot reasonably be verified.

7. Construction Projects and Site Information

Users may provide information concerning construction projects, including project requirements, location information, construction stage, materials, images, documents, measurements or other project-related information.

You are responsible for ensuring that you have appropriate rights and permissions to provide such information.

BuildFund does not guarantee the accuracy, completeness or suitability of information submitted by another user.

8. Products, Materials and Listings

Product information, descriptions, specifications, images, availability, pricing and other information may be provided by users, traders, contractors, manufacturers, suppliers or other third parties.

BuildFund does not independently guarantee that every listing or product description is accurate, complete, current or suitable for a particular construction requirement.

Users should independently verify material specifications, quantities, compatibility, quality, certifications, warranties and other relevant information before making purchasing or construction decisions.

9. No Professional or Technical Advice

Information available through BuildFund is provided for general informational and platform-related purposes.

Unless expressly stated otherwise, BuildFund does not provide architectural, structural, engineering, legal, financial, tax, construction-safety or other professional advice.

Users should consult appropriately qualified professionals before making decisions requiring professional judgment.

10. User-to-User Interactions

BuildFund may facilitate communication or discovery between users. However, users remain responsible for their interactions, negotiations, agreements and dealings with other users.

BuildFund is not a party to agreements independently entered into between users unless expressly stated otherwise.

Users should independently verify the identity, credentials, authority, product information, quotations and other representations of another user before entering into any arrangement.

11. Orders, Enquiries and Transactions

Where BuildFund provides features relating to product enquiries, orders, quotations, deliveries or other commercial interactions, the relevant terms displayed at the time of the transaction may also apply.

BuildFund does not guarantee that a product, service, quotation, order or enquiry will result in a completed transaction.

Any agreement relating to price, quantity, quality, delivery, installation, construction work, warranty or other commercial terms should be confirmed directly between the relevant parties.

12. Payments

BuildFund does not currently operate or provide a payment gateway and does not use a third-party payment processor for processing payments through the Platform.

Accordingly, BuildFund does not currently process payment-card, UPI, banking or similar payment credentials for payment processing through the Platform.

If BuildFund introduces payment functionality in the future, additional terms, policies or disclosures may apply before such functionality is made available.

13. Delivery and Fulfilment

Where products or materials are supplied or delivered by a trader, supplier, contractor or other third party, the relevant supplier or service provider may be responsible for fulfilment, delivery schedules, transportation, installation and related obligations.

Users should review the applicable commercial terms before confirming an order or arrangement.

14. User Content

"User Content" means information, text, photographs, videos, documents, product information, project information, reviews, messages or other material submitted or made available by you through BuildFund.

You retain ownership of your User Content, subject to the rights necessary for BuildFund to operate the Platform.

By submitting User Content, you grant BuildFund a non-exclusive, limited, royalty-free licence to host, store, reproduce, process, communicate, display and otherwise use that content as reasonably necessary to provide, maintain, secure and improve the Platform and its related services, subject to applicable law and our Privacy Policy.

You represent that you have the necessary rights and permissions to submit the User Content.

15. Prohibited Activities

You must not use BuildFund to:

  • violate any applicable law or regulation;
  • create a false identity or impersonate another person or business;
  • provide false, misleading or fraudulent information;
  • upload content that you do not have the right to use;
  • harass, threaten or abuse another user;
  • attempt to obtain another person's account or personal information without authorisation;
  • distribute malware, viruses or other harmful code;
  • interfere with the security or operation of the Platform;
  • scrape, copy or systematically extract Platform data without permission;
  • use automated systems to access the Platform in a manner that may adversely affect its operation;
  • use the Platform for unlawful, fraudulent or deceptive activities; or
  • circumvent or attempt to circumvent Platform security or access controls.

16. Reviews, Ratings and Communications

Where BuildFund permits reviews, ratings, comments or other feedback, users must provide information honestly and must not manipulate reviews or ratings through fraudulent, misleading or coordinated activity.

BuildFund may remove or restrict content that violates these Terms, applicable law or Platform rules.

17. Intellectual Property

The BuildFund name, logo, branding, software, website design, interface, graphics, text, compilation of content and other Platform materials are owned by or licensed to BuildTech Technologies Pvt Ltd unless otherwise stated.

Except as expressly permitted by applicable law or by BuildFund in writing, you may not reproduce, modify, distribute, publicly display, sell, license, reverse engineer or commercially exploit BuildFund's proprietary materials.

BuildFund may contain links to websites, applications, products or services operated by third parties.

Third-party services may have their own terms and privacy policies. BuildFund is not responsible for the content, security, availability or practices of third-party services that are outside BuildFund's control.

19. Privacy and Personal Data

Your use of BuildFund is also governed by our Privacy Policy and Data Deletion Policy.

BuildFund may process digital personal data in accordance with applicable law, including the Digital Personal Data Protection Act, 2023 and applicable rules and regulations as and when applicable to the relevant processing.

The DPDP Act establishes a framework governing the processing of digital personal data and provides for rights and obligations concerning such processing.

20. Account Suspension and Termination

You may stop using BuildFund or request deletion of your account in accordance with our Data Deletion Policy.

BuildFund may suspend, restrict or terminate access to an account where reasonably necessary, including where:

  • these Terms are violated;
  • information provided is materially false or misleading;
  • fraudulent or unlawful activity is suspected;
  • there is a security or safety concern;
  • required verification cannot be completed;
  • continued access may create legal or regulatory risk; or
  • the Platform or a relevant feature is discontinued.

Where appropriate and legally permissible, BuildFund may provide notice before taking such action.

21. Data Deletion

You may request deletion of your BuildFund account and eligible personal information in accordance with the BuildFund Data Deletion Policy.

Certain information may need to be retained where required by applicable law, for legal claims, fraud prevention, security, dispute resolution, regulatory obligations or other legally permitted purposes.

22. Accuracy and Availability of the Platform

BuildFund seeks to keep the Platform available and information reasonably accurate, but does not guarantee that the Platform or all information will always be uninterrupted, error-free, complete or current.

Features may occasionally be unavailable because of maintenance, technical issues, network interruptions, security events, third-party dependencies or circumstances beyond our reasonable control.

23. Disclaimer of Warranties

To the extent permitted by applicable law, the Platform and its features are provided on an "as available" and "as is" basis.

BuildFund does not make warranties regarding the accuracy, reliability, availability, suitability or completeness of third-party information, listings, products, services or user-generated content.

Nothing in these Terms excludes any warranty, right or protection that cannot lawfully be excluded under applicable law.

24. Limitation of Liability

To the maximum extent permitted by applicable law, BuildTech Technologies Pvt Ltd and its directors, employees, representatives and service providers shall not be liable for indirect, incidental, special, consequential or similar losses arising from your use of or inability to use the Platform.

This limitation does not apply to liability that cannot lawfully be excluded or limited under applicable law, including where such limitation is prohibited by law.

25. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless BuildTech Technologies Pvt Ltd and its directors, employees, officers and representatives from claims, losses, liabilities, damages and expenses arising from:

  • your violation of these Terms;
  • your unlawful use of the Platform;
  • your User Content;
  • your violation of another person's rights; or
  • your fraudulent or unauthorised activities.

26. Force Majeure

BuildFund will not be responsible for delays or failures caused by events beyond its reasonable control, including natural disasters, government actions, internet or telecommunications failures, cyber incidents, infrastructure failures, strikes, epidemics, war or other circumstances beyond reasonable control.

27. Changes to the Platform

BuildFund may modify, suspend, replace or discontinue any feature or part of the Platform at any time.

Where material changes affect these Terms, BuildFund may provide notice through the Platform, email or another legally appropriate method.

28. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Platform, applicable law, business practices or security requirements.

The updated Terms will be published on the Platform with an updated "Last Updated" date. Your continued use of BuildFund after the effective date of updated Terms may constitute acceptance to the extent permitted by applicable law.

29. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of India, subject to applicable statutory provisions.

30. Dispute Resolution

If you have a concern or dispute relating to BuildFund, you should first contact us at support@buildfund.in so that we can attempt to resolve the matter.

Nothing in these Terms prevents a user from exercising any statutory right or remedy available under applicable law.

31. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it enforceable, where legally permitted. The remaining provisions shall continue to apply.

32. Waiver

A failure or delay by BuildFund in exercising any right under these Terms shall not constitute a waiver of that right.

33. Entire Agreement

These Terms, together with the Privacy Policy, Data Deletion Policy and any additional terms specifically applicable to particular features, constitute the understanding between you and BuildFund concerning your use of the Platform, subject to applicable law.
