1. Acceptance of Terms

These Terms & Conditions (“Terms”) govern your access to and use of the BuildFund website (https://buildfundindia.com) and Android app (together, the “Platform”). By registering for or using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility & Registration

  • You must be at least 18 years old to register as a Contractor or Trader.
  • Contractor and Trader registrations are reviewed by our team before approval. We may approve, reject, or request additional information at our discretion.
  • You agree to provide accurate, current, and complete information during registration and KYC, and to keep it updated.
  • You are responsible for maintaining the confidentiality of your account credentials.

3. User Roles

  • Homeowners use the Platform to discover and connect with Contractors. BuildFund does not employ or supervise Contractors and is not a party to any agreement between a Homeowner and a Contractor.
  • Contractors use the Platform to manage construction sites and place material orders with Traders.
  • Traders use the Platform to list materials and receive orders from Contractors. Traders are solely responsible for the accuracy of their listings, pricing, and the quality of materials supplied.

4. Orders & Transactions

  • Orders placed through the Platform are agreements between the ordering Contractor and the fulfilling Trader. BuildFund facilitates the connection but is not a party to the sale.
  • Payment for materials is arranged directly between the Contractor and the Trader. BuildFund does not process, hold, or guarantee any payments made between users.
  • Traders may accept or reject an order, and must provide a reason when rejecting. Order status updates (accepted, processing, dispatched, delivered) are managed by the Trader.
  • BuildFund does not track live inventory — a Trader’s listed stock is not a guarantee of availability at the time of order.

5. Acceptable Use

You agree not to:

  • Provide false, misleading, or fraudulent information, including KYC or business documents.
  • Use the Platform for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to another user’s account or data.
  • List or attempt to order prohibited or illegal materials.
  • Interfere with or disrupt the security or performance of the Platform.

6. Account Suspension & Termination

We may suspend or deactivate your account if we reasonably believe you have violated these Terms, provided false information, or engaged in fraudulent or harmful activity. Where possible, we will notify you of the reason. You may also request deletion of your account at any time in accordance with our Data Deletion Policy.

7. Intellectual Property

The BuildFund name, logo, app, and website content are the property of BuildFund and may not be copied, modified, or used without our prior written consent.

8. Disclaimers & Limitation of Liability

The Platform is provided on an “as is” basis. See our Disclaimer for details on the limits of our responsibility for transactions and content between users. To the fullest extent permitted by law, BuildFund is not liable for any indirect, incidental, or consequential damages arising from your use of the Platform.

9. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date above, and where appropriate, communicated through an in-app or push notification. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
